YOU UNDERSTAND THAT BY ACCESSING OR USING THE SITES OR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO BE LEGALLY BOUND BY AND COMPLY WITH THESE TERMS OF USE. IF YOU DO NOT OR CANNOT AGREE WITH ANY PART OF THESE TERMS OF USE, YOU MAY NOT USE THE SITES OR ANY SERVICES PROVIDED ON OR THROUGH THE SITES.

Mango Telehealth Inc., operating as
Mojo Health – GLP-1 Weight Loss and its respective affiliates (collectively, “Mojo Health – GLP-1 Weight Loss”, “we”, “us”, or “our”) own and operate the websites located at
https://staging.weightlossplus.ca and
www.weightlossplus.ca (collectively, the “Websites,” and together with any affiliated mobile application (“App”), the “Sites”).
The Sites facilitate the provision of telehealth services (the “Services”) to registered users in Ontario, Canada. The Services include: (i) providing information on health care and wellness; (ii) providing pharmacy services; (iii) development and gathering of health records for use in appointments and pharmacy services; (iv) administrative support for scheduling and payment; and (v) telecommunications support for direct access to Ontario-regulated health care providers for communication, consultations, assessments, and treatment.
Your access to and use of the Sites and Services is subject to these Terms of Use, our Privacy Policy (available at
https://staging.weightlossplus.ca), and all applicable Ontario and Canadian laws, including the Personal Health Information Protection Act, 2004 (PHIPA), the Regulated Health Professions Act, 1991, and regulations of the College of Physicians and Surgeons of Ontario (CPSO) and the Ontario College of Pharmacists (OCP).
We reserve the right to update these Terms of Use at any time. Changes are effective upon posting. Your continued use of the Sites or Services constitutes acceptance of the updated Terms.
Use of the Sites and Services constitutes acceptance of Bask Health Inc.’s platform and its applicable privacy policy (available at bask.health and bask.bio).
Availability
Services are currently available only to individuals located in
Ontario, Canada.
Eligibility
To use the Services, you must: • Be 18 years of age or older; • Be located in Ontario; • Agree to be legally bound by these Terms of Use.
Satisfying these requirements does not guarantee you will receive Services. Mojo Health – GLP-1 Weight Loss and affiliated professional entities reserve the right to change eligibility requirements without prior notice.
Requirements for Use
You must have compatible devices, Internet access, and necessary software. Internet and mobile carrier fees may apply.
Special Consent to Telehealth Services
Telemedicine involves the delivery of health care services using electronic communications when you and your health care provider are not in the same physical location. It may include transmission of medical records, images, or data, and interactions via audio, video, or text.
We incorporate network and software security protocols to protect your health information in accordance with PHIPA.
Please review our separate Consent to Telehealth form for risks and benefits. It is incorporated into these Terms of Use by reference.
Privacy Policy
We are committed to protecting your personal health information under PHIPA. Please see our Privacy Policy at
https://staging.weightlossplus.ca and the Notice of Privacy Practices of our affiliated health care providers. Both are incorporated into these Terms of Use by reference.
Your Relationship with Mojo Health – GLP-1 Weight Loss
Mojo Health – GLP-1 Weight Loss does not provide medical services. We provide a technology platform that connects you with Ontario-regulated health care providers. Services are not a substitute for in-person care. You are not entering into a physician-patient relationship with Mojo Health – GLP-1 Weight Loss.
You consent to receiving disclosures, notices, messages, and reports via email, text, or the platform. You are responsible for reading them.
Communications by Text Message and Email
By opting in to text messages or providing your email, you consent to receive transactional, promotional, and health-related messages (unencrypted). Standard carrier charges apply. You may opt out anytime by replying “STOP” or contacting
[email protected].
Pharmacy Services
If you receive a prescription as a result of your use of the Services, you may select the
Mojo Health – GLP-1 Weight Loss Pharmacy Partner to fulfill and ship your prescription. You may also choose to have your prescription fulfilled through the pharmacy of your choice when prompted during your use of the Services.
You give us consent to send and disclose to the
Mojo Health – GLP-1 Weight Loss Pharmacy Partner or the pharmacy of your choice all information provided by you, health care records, and other applicable health care information and personal information (such as your name, location, and demographic information) so that you may receive pharmacy services.
Packaging Notice If you select the Mojo Health – GLP-1 Weight Loss Pharmacy Partner to fulfill any prescriptions, you acknowledge that your medication will not be shipped in child-resistant packaging and that you must keep it out of the reach of children.
Governing Law; Dispute Resolution
These Terms of Use and your use of the Sites and Services are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
Any dispute arising under these Terms shall be resolved exclusively in the courts of Ontario located in Hamilton. You agree to the exclusive jurisdiction and venue of these courts.
If any provision is found invalid, the remainder remains in full force.
Limitation of Liability (Strengthened for Provider Protection)
TO THE MAXIMUM EXTENT PERMITTED BY ONTARIO LAW, MOJO HEALTH – GPL-1 WEIGHT LOSS AND ITS RELATED PERSONS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES arising from your use of the Sites or Services.
Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim.
Indemnification
You agree to indemnify and hold harmless Mojo Health – GLP-1 Weight Loss, its affiliates, and their directors, officers, employees, and agents from any claims, losses, or expenses (including reasonable legal fees) arising from your use of the Services, breach of these Terms, or violation of any law.
